By accessing or using the NowPlaying platform ("Service"), including our website, widgets, APIs, and Twitch bot integrations, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

NowPlaying provides tools for content creators to display their currently playing music on stream overlays, manage song request queues, and integrate with third-party music services such as Spotify. The Service may include free and premium tiers with varying feature sets.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 13 years old to use the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Use the Service to distribute spam, malware, or other harmful content.
• Abuse, harass, or threaten other users of the Service.
• Circumvent rate limits or other technical restrictions imposed by the Service.

5. Third-Party Services

NowPlaying integrates with third-party services such as Spotify, Twitch, and Google. Your use of those services is subject to their respective terms and privacy policies. NowPlaying is not responsible for the content, policies, or practices of any third-party service.

6. Premium Subscriptions

Certain features require a paid subscription. Subscriptions are billed through Stripe. You may cancel at any time; access continues through the end of your billing period. Refunds are handled on a case-by-case basis. We reserve the right to change pricing with reasonable notice.

7. Intellectual Property

All content, branding, and code that make up the NowPlaying Service are the property of NowPlaying and its creators. You retain ownership of any content you create using the Service. You grant NowPlaying a limited license to display that content as necessary to operate the Service.

8. Account Suspension & Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in behavior that is harmful to the Service or other users. You may also delete your account at any time by contacting support.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, NowPlaying and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes via the Service or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
